The court operated under specific procedural rules designed to expedite decisions and provide non-technical forums where workers and employers could present cases without necessarily requiring lawyers. The court's jurisdiction was carefully limited to specific categories of disputes, with some matters (particularly grievances handled through collective bargaining) remaining outside court authority. This jurisdictional limitation meant the court's practical importance was restricted despite its specialized nature.

The Labour Court's actual effectiveness in protecting workers was substantially constrained by multiple structural factors. The court lacked independent enforcement capacity; employers could violate court judgments with minimal consequences, as the courts relied on government goodwill to enforce decisions. Workers' inability to afford lawyers meant many workers presented cases without legal representation, disadvantaging them against employers who hired experienced labour lawyers. The court's emphasis on technical legal arguments rather than substantive fairness meant workers' material circumstances received less consideration than strict legal interpretation. The court's slow decision-making process meant workers faced extended periods without resolution while needing immediate income, creating pressure to accept unfavorable settlements.

The court's relationship with government labour policy was often tense, as governments pursuing particular wage or labour relations policies sometimes pressured the court to rule favorably toward government objectives. During economic crisis periods when government sought wage restraint, court decisions showed tendency to favor employer positions, suggesting political influence. This compromised the court's legitimacy in workers' eyes, as the court was perceived as another state institution aligned against worker interests rather than neutral arbiter.

From the 1970s onwards, the Labour Court gained greater autonomy and developed more sophisticated jurisprudence addressing complex labour matters. However, the court's authority over workers' primary enforcement mechanism (strikes) remained limited, as workers could circumvent court processes through workplace action. The expansion of informal employment created cases outside the Labour Court's jurisdiction, as many informal workers lacked legal standing to access court processes. Contemporary Kenya retains the Labour Court (renamed the Labour and Employment Court in later reforms), but its actual significance in resolving labour disputes has declined as workers and employers rely more on negotiation, informal settlement, and labour-specific mechanisms outside court structures.
