Industrial relations in Kenya emerged as a formal field addressing labour-capital interactions and conflict management within a regulatory framework. The term reflected post-independence transition from colonial labour control toward ostensibly managed systems of labour relations involving government, employers, and unions as tripartite partners. Industrial relations frameworks were designed to institutionalize conflict, providing formal mechanisms for dispute resolution as alternative to strikes and uncontrolled worker action. However, actual industrial relations practice remained highly contested, with fundamental conflicts regarding legitimacy and power persisting.

The Industrial Relations Charter, adopted in the 1960s, represented Kenya's initial framework for managing labour relations. The charter established principles including workers' rights to organize and bargain collectively, but also emphasized responsibilities to maintain production and social stability. The charter reflected a compromise position attempting to balance worker rights with capitalist interests and government stability objectives. In practice, the charter weighted heavily toward stability and production maintenance; worker rights were conditional on their exercise not disrupting production. The charter's provisions regarding strike notification and mandatory negotiation before strikes were interpreted as empowering government to suppress strikes.

The institutional structure for industrial relations included tripartite mechanisms bringing together government, employers, and union representatives to discuss labour policy, resolve disputes, and coordinate wage-setting. The tripartite forums theoretically gave workers voice in shaping labour policy. However, the actual power dynamics were asymmetrical: government retained authority to make final decisions; employers possessed economic power threatening investment and employment; workers had only their capacity for labour withdrawal. Tripartite forums frequently resulted in union acquiescence to government and employer positions, particularly during economic crisis.

The Industrial Court and labour dispute mechanisms emerged as key institutions in the industrial relations framework. These specialized forums were intended to provide neutral arbitration of labour disputes, preventing strikes through formal dispute resolution. However, their effectiveness was constrained by multiple factors: slow processes; expensive procedures; workers' lack of trust in neutrality; and enforcement limitations. Labour unions increasingly viewed formal dispute resolution mechanisms with suspicion, perceiving them as means to suppress strike action rather than protect worker interests. Industrial relations institutions became objects of contest rather than accepted mechanisms.

Industrial relations became progressively more contentious as labour market changes undermined traditional frameworks. The rise of casual employment and fragmentation of the formal labour force meant that industrial relations mechanisms designed for stable formal employment sectors became less relevant. Informal sector workers operating outside traditional employment relationships lacked capacity to utilize industrial relations mechanisms. The growth of precarious employment undermined the assumption of ongoing employment relationships on which industrial relations frameworks were based.

Contemporary industrial relations in Kenya remain formally structured around tripartite mechanisms and formal dispute resolution, yet increasingly disconnected from actual labour market realities. Formal sector workers and their unions continue engaging in industrial relations processes; however, the majority of workers in informal and casual employment operate outside these structures. The framework designed to manage labour conflict increasingly manages conflict among formal sector workers while informal sector dynamics remain unaddressed. The result is a bifurcated system where industrial relations mechanisms cover shrinking proportion of labour force.
