Labour dispute resolution mechanisms in Kenya evolved from informal employer-dominated processes to increasingly formal institutional structures, though effectiveness remained inconsistent. In the earliest colonial period, disputes were resolved entirely through employer authority and colonial administrative officials applying arbitrary standards. As labour organization developed, workers gained capacity to pursue disputes through collective action, establishing strike threat as the primary mechanism for forcing dispute resolution favorable to worker interests. However, formal mechanisms to resolve disputes without disruption also developed, reflecting both government and employer desire to prevent strikes.

The colonial government eventually established labour officers and boards to adjudicate specific disputes, though these mechanisms were primarily designed to limit strike activity rather than ensure fair worker treatment. The Labour Commissioner position created a formal locus of authority for hearing disputes, though the Commissioner typically sided with employers and colonial interests. Workers could appeal employer disciplinary decisions through the Commissioner, but success was rare given the Commissioner's structural alignment with colonial economic interests. The mechanisms existed more as safety valves preventing complete breakdown than as genuinely neutral arbitration structures.

Post-independence Kenya retained and expanded formal dispute resolution mechanisms, establishing the Industrial Court in the 1960s as a specialized tribunal for labour disputes. The Industrial Court was intended to provide neutral arbitration preventing strikes while protecting worker rights. However, the court's effectiveness was undermined by multiple factors: workers and unions lacked trust in court impartiality; legal processes were expensive and slow; most workers could not afford legal representation; and the court's authority to enforce awards against employers remained limited. Employers could violate court decisions with minimal consequences, making formal dispute resolution less relevant than direct labour action.

The Industrial Relations Charter, adopted in 1962 and subsequently modified, established procedural requirements for dispute handling including mandatory negotiation before strikes and involvement of labour officers in mediation. This framework aimed to regularize labour conflict management while preventing disruption to essential services and production. However, implementation remained spotty: employers often ignored procedural requirements; government enforcement was inconsistent; and workers continued employing strikes as the primary mechanism for dispute resolution when negotiation failed. The formal procedures were frequently bypassed by both workers using unauthorized strikes and employers implementing unilateral disciplinary measures.

Dispute resolution complexity increased substantially as employment forms proliferated. Collective disputes involving unions and employers could theoretically access Industrial Court processes, but individual wrongful dismissal cases encountered greater difficulty. The rise of casual and contract labour from the 1980s onwards created disputes that formal mechanisms poorly addressed, as casual workers lacked protections and collective representation. Contemporary Kenya maintains formal dispute resolution structures that theoretically provide neutral arbitration, but actual workers rely more heavily on informal negotiation, labour lawyers (accessible primarily to wealthier workers), and strike threats for effective dispute resolution.
