The county's approximately 22,796 square kilometers comprise primarily pastoral grazing lands organized historically through customary clan-based resource management systems. Colonial administration introduced state land classification and ownership categories, overlaying customary tenure with government-defined land rights, creating tensions that persist.
Customary pastoral land tenure in Garissa, predating colonial and modern government land law, organized land access and use through clan allocation of grazing territories and water sources. Clan elders maintained custodianship of communal grazing lands, allocating seasonal grazing rights to clan members and managing resource conflicts. This communal tenure system, while not providing individual land titles, offered security through clan membership and recognized use rights. Pastoral mobility, essential to pastoral livelihoods, operated within customary understandings of clan territories that transcended fixed boundaries and allowed seasonal movements across regions.
Colonial administration's introduction of state land classification created three major land categories: (1) Crown Lands (state-owned lands), (2) Native Reserves (lands designated for "native" African occupation and use), and (3) Freehold Lands (privately owned lands, in practice primarily occupied by European settlers outside the NFD). The Northern Frontier District, comprising most of present Garissa, was classified as Crown Land with restricted European settlement, though the distinction proved less meaningful than in developed colonial zones.
The post-independence period created further complexity, with the Government of Kenya retaining ownership of Crown Lands but increasingly allocating fragments to individual occupants. The benefits of individual titling, including collateral access for credit, are unavailable to most pastoral land users who lack formal titles.
Land conflicts in Garissa include disputes over grazing territory boundaries between pastoral groups, competition between pastoral and irrigation interests, and conflicts between national conservation interests (particularly relating to wildlife protection) and pastoral resource use. These conflicts are typically resolved through combinations of customary dispute resolution mechanisms (clan elder mediation) and state legal processes (district and high court proceedings). The effectiveness of these mechanisms varies, with some conflicts escalating to violence when formal resolution mechanisms fail.
Pastoral land degradation and desertification have reduced land productivity, necessitating more extensive territorial claims by pastoral groups to sustain livestock production. Protected areas and wildlife reserves restrict pastoral grazing in valuable ecological zones, reducing pastoral access while providing conservation benefits. Communities adjacent to protected areas argue that wildlife conservation benefits accrue nationally or globally while local communities bear costs through restricted resource access.
The Land and Environment Court, established through the 2010 Constitution to handle land disputes, provides specialized forum for land-related cases. However, access to court processes by poor pastoral communities remains limited due to costs and complexity of formal litigation.
