Land represents the most fundamental resource in Embu County's agricultural economy, yet the county faces critical challenges including land fragmentation from inheritance divisions, disputes regarding land ownership boundaries, and competition between agricultural production and conservation objectives. The system of land tenure and property ownership has evolved from pre-colonial customary land stewardship through colonial land appropriation and registration toward the contemporary system of individual land titles registered through the national Land Registry. This evolution has created significant changes in how Embu residents access land, use land, and resolve land disputes, with contemporary land relationships operating within a formal legal framework that sometimes conflicts with customary land traditions.

The pre-colonial land system in Embu was based on communal and clan-based stewardship rather than individual ownership. Land was held collectively by communities, with families having use rights to specific land areas for cultivation. Grazing lands were managed communally, with community members entitled to pasture livestock on community grazing areas. This system enabled land reallocation when families' productive capacity or household size changed, maintaining relatively equal land distribution within communities. Individuals could not permanently alienate land from their clan or community, creating a system that prioritized community food security over individual accumulation.

Colonial land policies fundamentally transformed Embu's land system through official appropriation of the best-watered agricultural lands for European settlement. Large areas of prime agricultural land on Mount Kenya's slopes were transferred to European settlers through formal title registration, eliminating Embu people's customary access to these lands. Embu communities were compressed into smaller reserves of lower-potential land, disrupting the land availability that had traditionally enabled flexibility in land distribution. The colonial government began a cadastral survey and land registration process, formally documenting land parcels and associating ownership with individual registered titles. This transformation from customary communal stewardship to formal individual title registration created the foundation for contemporary land system structures.

Post-independence governments maintained the formal land registration system inherited from the colonial period, with the national government assuming ownership of government-held land and individuals maintaining title to previously registered private land. The 1968 Registered Land Act established procedures for land registration and transfer through formal legal channels. This system enabled land sales and transfers through market mechanisms but eliminated the flexibility of customary systems where land could be reallocated based on community needs. Individuals increasingly viewed land as a capital asset with market value rather than as a resource managed for family subsistence and community stewardship.

Land fragmentation has become an acute challenge in Embu as family holdings have been divided among multiple heirs with each generation. Traditional inheritance practices often divided land equally among all children, creating progressively smaller parcels as land was inherited by subsequent generations. Holdings that were economically viable for farming at two hectares became fragmented into plots of 0.5 hectares or smaller when inherited by multiple children. This fragmentation reduces the land available for individual farmer income generation and sometimes results in plots too small for viable agricultural production. Some young people have been unable to access land for farming, contributing to youth unemployment and migration to urban areas.

Land disputes have become increasingly common as population density increases and land values rise. Disputes regarding inheritance of deceased individuals' land create family conflict when multiple potential heirs claim entitlement to the same property. Disputes regarding informal sale agreements or lending arrangements occur when oral agreements are disputed by parties with differing recollections. Many land disputes remain unresolved for extended periods, constraining affected individuals' ability to develop their land or use land as collateral for loans.

The constitution adopted in 2010 included provisions establishing community land as a recognized category distinct from government land and private land. Community lands are defined as lands traditionally occupied by communities or held in common by communities. In Embu, community lands include grazing lands, forests, and other traditionally communal lands. The constitution specified that community lands must be managed by community land trusts acting as trustees on behalf of communities. However, the implementation of community land provisions has progressed slowly, with limited clarity regarding which specific Embu lands should be designated as community lands and limited progress in establishing community land trusts.

Land rights for women remain problematic in Embu despite legal provisions establishing women's equal rights to land. Customary practices in many Embu communities historically excluded women from land ownership, restricting women's access to land through husbands or male relatives. Contemporary legal frameworks including the Constitution provide women with explicit land rights. However, customary practices limiting women's land rights continue in some communities, with women sometimes unable to inherit land or exercise control over inherited land. The Land Act specifies that land ownership must be registered in the names of all relevant parties including women landowners, but registration practices sometimes exclude women's names from title documents. Land disputes sometimes arise when women attempt to exercise land rights against customary practices.

Land use planning and zoning has been limited in Embu, with few formal land use designations or zoning regulations guiding development. Agricultural land has gradually converted to residential use in areas near towns as people establish residences while continuing agricultural activities or abandoning agriculture. Forest conservation areas have been pressured by illegal logging and agricultural encroachment, reducing forest area. Water sources and riparian areas have experienced encroachment and agricultural use, degrading water resources. Formal land use planning incorporating conservation objectives, agricultural productivity maintenance, and sustainable settlement patterns would improve land use efficiency but remains underdeveloped.

Land lending and collateral practices have expanded as formal financial institutions enter Embu. Agricultural input suppliers offer credit enabling farmers to purchase fertilizer, seed, and other inputs, using land as collateral for credit repayment. Agricultural banks have offered agricultural credit secured by land title registration. However, land collateral requirements have sometimes worked against poor farmers unable to obtain title registration or unwilling to risk losing land if credit repayment becomes difficult. Interest rates on agricultural credit have sometimes been prohibitively high, limiting farmer access to credit.

The National Land Commission established by the 2010 Constitution has the mandate to investigate historical land injustices and recommend resolutions. For Embu, colonial land appropriation represents a historical land injustice that dispossessed Embu communities of prime agricultural lands. However, the practical implementation of recommendations regarding historical land grievances has been limited, with few direct restitutions or compensation made to communities affected by colonial land appropriation.
