The Music Copyright Society of Kenya (MCSK) stands at the center of Kenya's most persistent music industry controversy: the collection and distribution of royalties owed to artists whose work is played publicly. Established as a collective management organization to represent over 16,000 members, MCSK's history has been marked by legal battles, licensing disputes, allegations of financial mismanagement, and ongoing questions about whether the organization serves artists' interests or exploits them.

MCSK's mandate is straightforward: collect royalties when music is played in public venues (bars, restaurants, matatus, hotels, radio stations, etc.), then distribute those collections to rights holders. In functional copyright ecosystems, collective management organizations provide essential service, allowing artists to earn from their work without individually monitoring every venue that plays their music. But MCSK's execution of this mandate has been contested repeatedly, generating lawsuits, regulatory interventions, and widespread artist skepticism about the organization's effectiveness and integrity.

The Kenya Copyright Board (KECOBO) supervises MCSK and other collecting societies, responsible for ensuring proper licensing, accounting, and distribution practices. This oversight relationship has itself been contentious. In 2015, several artists including Elijah Wainaina Mira, Francis Jumba, and Carolyne Wanjiru Ndiba filed suit against MCSK, the Copyright Board, and other organizations, claiming the right to collect royalties for their own works rather than ceding that power to MCSK. The lawsuit highlighted fundamental questions about whether collective management was serving artists or extracting value without delivering corresponding benefits.

Recent years have seen escalating crisis. In 2024-2025, the Copyright Tribunal barred MCSK from collecting and distributing royalties due to lack of a valid operating license, a ruling stemming from MCSK's failure to submit certified annual returns and audited accounts for five years, documents essential for demonstrating proper financial management. This failure to meet basic administrative requirements raised serious questions about organizational competence and transparency. How could an organization claiming to represent thousands of artists not file required financial documentation?

Despite tribunal rulings and regulatory pressure, MCSK has continued operating under court orders that extended and confirmed their authority to collect royalties pending full legal resolution. This legal limbo, where the organization lacks proper licensing but continues functioning under temporary court permissions, exemplifies the dysfunction plaguing Kenya's copyright infrastructure. Artists remain caught between theoretical rights to royalty payments and practical inability to access those payments through legitimate, transparent channels.

The fundamental problem MCSK embodies is trust collapse. Even when the organization collects royalties successfully, artists doubt whether distributions are accurate, transparent, or fairly calculated. Stories circulate of artists receiving pennies while MCSK staff allegedly enrich themselves. Whether these stories reflect systematic corruption or organizational incompetence matters less than their effect: widespread belief among Kenyan musicians that MCSK cannot or will not deliver the royalties they are owed.

Alternative collection mechanisms have struggled to gain traction. The Performers Rights Society of Kenya and the Kenya Association of Music Producers exist alongside MCSK, creating potential competition but also fragmentation that confuses both artists and businesses required to pay royalties. Some artists have attempted direct licensing, negotiating individually with venues and media outlets, but this approach only works for high-profile musicians with leverage and resources to enforce agreements.

The international dimensions complicate matters further. Kenyan music played internationally should generate royalties collected by foreign collecting societies and remitted to MCSK for distribution to Kenyan rights holders. But if MCSK lacks proper licensing or credibility with international partners, these revenue streams may not flow properly. Sauti Sol's international success, diaspora consumption of Kenyan music, and streaming platforms' global reach all create royalty obligations that require functional collection infrastructure.

The post-2022 government has periodically signaled interest in copyright reform and better protection for artists, but concrete action has been limited. Political will to fix MCSK's dysfunction runs up against vested interests benefiting from the current chaotic system. Reforming copyright collection would require regulatory capacity, political will, and likely new legislation, all scarce commodities in Kenya's often-dysfunctional governance ecosystem.

For working Kenyan musicians, MCSK's failures translate directly into lost income. A song played hundreds of times daily across Nairobi's matatus should generate meaningful royalties. Radio hits should produce sustainable income streams beyond initial performance fees. International streaming should trigger cross-border royalty flows. But in practice, most Kenyan artists see nothing, or almost nothing, from these uses of their work. The gap between theoretical copyright protection and practical royalty collection remains vast, and MCSK, rather than bridging that gap, has become its symbol.

The ongoing MCSK crisis reflects broader challenges in Kenya's creative industries: weak regulatory enforcement, organizational dysfunction, power imbalances between artists and intermediaries, and persistent questions about whether institutional frameworks serve creators or extract from them. Until MCSK is fundamentally reformed or replaced with credible alternatives, Kenya's musicians will continue creating valuable work while struggling to capture fair value from it. The battle over royalties is not just about money; it is about whether Kenya's music industry can develop functional institutions that protect and empower artists rather than exploiting them.
