However, the gap between legislation and enforcement meant that the Act's actual impact on musicians' lives was limited, leaving artists vulnerable to exploitation even as the law theoretically protected their rights.
The 1966 Act drew heavily from British copyright law, reflecting Kenya's colonial legal inheritance. It established that copyright vested automatically in creators upon fixation of their work (such as recording a song), without requiring registration. This automatic protection theoretically benefited musicians who might lack resources to navigate bureaucratic registration processes. The law recognized both compositional copyright (in the underlying musical work and lyrics) and recording copyright (in the specific performance captured on tape or vinyl), creating dual layers of protection.
In practice, the Act's protections proved difficult to enforce. The legislation required that infringement cases be prosecuted through Kenya's court system, but few musicians had resources to hire lawyers or pursue lengthy litigation. Court processes were slow and expensive, making legal action impractical for most artists. Additionally, judges and magistrates often lacked understanding of music industry economics or copyright principles, leading to inconsistent rulings that failed to establish clear precedents.
The most significant practical failure was the Act's ineffectiveness against piracy. By the 1970s, cassette technology made it easy to duplicate recordings, and informal operators produced and sold pirated cassettes throughout Kenya. These operations undercut legitimate sales, depriving musicians and record labels of revenue. While the Copyright Act criminalized such piracy, enforcement was minimal. Police lacked training in intellectual property enforcement, and the small penalties didn't deter piracy's substantial profits.
The Act's provisions for licensing and collective administration pointed toward systems that would eventually emerge but didn't exist in the 1960s and 1970s. The law anticipated that collecting societies would be established to gather royalties from radio broadcasts, public performances, and mechanical reproduction. However, such organizations developed slowly, leaving musicians without effective mechanisms to collect money owed to them. Voice of Kenya radio broadcast music extensively but operated without systematic royalty payment systems for years.
Recording contracts between musicians and record labels often included clauses where artists signed away copyrights in exchange for small upfront payments. The Copyright Act didn't prohibit such transfers, and musicians desperate for money or lacking legal advice regularly agreed to unfavorable terms. Labels like Polygram and EMI used standard contracts that heavily favored the company, and musicians had little bargaining power to negotiate better deals. The Act's theoretical protections meant nothing when artists voluntarily (if under duress) assigned their rights to companies.
The international dimension of copyright created additional complications. Kenya's 1966 Act provided protection within Kenya's borders, but Kenyan music circulated regionally and occasionally globally. Fadhili Williams's struggle to receive royalties for "Malaika" from international recordings illustrated how territorial limitations of copyright law disadvantaged African artists. International copyright treaties existed, but Kenya's participation was limited, and enforcement across borders was effectively impossible for individual musicians.
Moral rights, which protect artists' reputations and the integrity of their work, received limited attention in the 1966 Act. The legislation focused primarily on economic rights (who could profit from copying or performing works) rather than artists' rights to control how their works were modified or attributed. This meant that covers of Kenyan songs, international adaptations, or unauthorized modifications faced minimal legal obstacles, even when they distorted original meanings or misattributed authorship.
The Act's inadequacy became increasingly apparent through the 1970s and 1980s as the music industry grew. Musicians' organizations and industry advocates pushed for reforms, arguing that weak copyright enforcement undermined Kenya's creative economy. These reform efforts eventually led to updated legislation in 2001, though implementation challenges persisted. The 1966 Act remained in force for 35 years, shaping (and failing to adequately protect) multiple generations of Kenyan musicians.
Comparative perspectives reveal that weak copyright enforcement was common across African countries during this period. Kenya's situation was neither uniquely bad nor particularly good. The challenges reflected broader issues: limited state capacity for enforcement, prioritization of other government functions over intellectual property, and power imbalances between multinational corporations and individual artists. These structural problems required more than better legislation to address.
The Copyright Act's existence did provide some framework for thinking about creative ownership, even when enforcement failed. Musicians learned to think about copyright, to include copyright terms in contracts, and to understand (at least abstractly) that their creative work had legal protection. This consciousness-raising function, while not translating directly to economic benefit, laid groundwork for subsequent activism around artists' rights.
For historians, the 1966 Copyright Act serves as a window into post-independence Kenya's contradictions. The government aspired to modern legal frameworks that would protect creative workers and support cultural industries, but lacked capacity or will to enforce those frameworks effectively. The gap between aspiration and reality characterized not just copyright law but many aspects of Kenya's development trajectory during the Kenyatta era.
