The Proposed Deals

In 2024, the Ruto government entered into negotiations with Adani Group (Indian conglomerate based in Mumbai, led by Gautam Adani) for two major contracts:

  1. Jomo Kenyatta International Airport (JKIA) Management: A 30-year concession to manage East Africa's largest airport
  2. Kenya Power Transmission: Contracts related to power transmission infrastructure

The Scale of the Deals

The JKIA management deal was valued at hundreds of millions of dollars and represented one of Africa's largest private sector takeovers of critical infrastructure.

The power transmission contracts were similarly valuable, potentially worth billions of shillings.

The Controversy

Multiple concerns were raised about the deals:

  • Lack of transparency: The contracts were negotiated without extensive public consultation
  • Terms unfavorable to Kenya: Critics alleged that the terms favored Adani Group more than Kenya
  • Corruption allegations: Questions were raised about whether Adani had offered payments to Kenyan officials to secure the contracts
  • Foreign control: Concerns about ceding control of critical infrastructure to foreign companies

Civil society, opposition politicians, and media raised objections to the proposed deals.

The US DOJ Indictment and Withdrawal

In November 2024, the United States Department of Justice announced an indictment of Gautam Adani (the billionaire owner of Adani Group) and others, alleging bribery and fraud related to solar energy projects in India.

The indictment did not specifically allege corruption related to the Kenya deals. However, the disclosure of Adani's involvement in bribery in India raised questions about whether Adani might engage in similar practices in Kenya.

Following the US indictment, public pressure on the Ruto government intensified. The government announced that it was withdrawing from the Adani deals.

Questions Unanswered

Several questions about the Adani controversy remained unanswered:

  • What were the specific terms of the proposed contracts?
  • How close was the agreement to finalization when the US indictment was announced?
  • Were any payments or benefits offered to Kenyan officials?
  • How much did the Ruto government know about Adani's alleged corruption in India?

The lack of transparency meant that public understanding of what had occurred was limited.

The Pattern

The Adani controversy followed the pattern of Kenya's infrastructure deals: negotiated non-transparently with foreign investors, raising corruption and fairness concerns, and ultimately subject to reversal or major renegotiation.
